Welcome to NicheHunter. These Terms of Service ("Terms") govern your access to and use of the NicheHunter platform, website, and services (collectively, the "Service") operated by NH Technologies LLC ("Company," "we," "us," or "our").

NicheHunter is an AI-powered product research platform that provides tools for discovering trending products, analyzing advertisements, and generating creative content for e-commerce businesses. The Service includes:

• AI Ad Explorer for Facebook and TikTok advertisements
• Trend Intelligence and analytics
• TikTok Shop analytics and data
• Creative Studio for generating marketing content
• Sales Analytics for tracking product performance

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Creative Studio Tokens

Creative Studio tokens are included with subscription plans and can be used to generate content within the platform. Tokens:

• Are allocated monthly based on your subscription tier
• Do not roll over to subsequent months
• Cannot be transferred or exchanged for cash
• May be purchased additionally through token packs

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems or software to extract data from the Service (scraping)
• Resell, redistribute, or sublicense access to the Service without authorization
• Use the Service to infringe upon intellectual property rights of others
• Upload or transmit viruses, malware, or other malicious code
• Harass, abuse, or harm other users of the Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any products discovered through the Service will be profitable
• The quality of products, services, or information obtained will meet your expectations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NH TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in any content or data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless NH Technologies LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If such negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
